Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Obscura Shopify application (“Obscura,” “the App,” or “the Service”). By installing or using the Service, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service.
Service Overview
Obscura is a print-on-demand service that integrates with Shopify, enabling merchants to publish and fulfill printed products through their online stores. Obscura manufactures and ships products based solely on orders submitted by merchants.
Obscura does not sell products directly to end customers. Merchants are responsible for store operations, pricing, customer communication, and compliance with applicable laws.
Eligibility and Authority
You must be at least 18 years old to use the Service.
By installing or using Obscura, you represent that you are authorized to act on behalf of the Shopify store connected to the Service and have the authority to bind that store or business to these Terms.
Account Responsibilities
You are responsible for all activity conducted through your Obscura account, including orders submitted, designs uploaded, and data provided.
You agree to:
- Provide accurate and complete store, billing, and shipping information
- Ensure submitted designs do not infringe third-party rights
- Maintain the security of your Shopify account credentials
Obscura is not responsible for errors or losses resulting from inaccurate or incomplete information provided by the merchant.
Orders and Fulfillment
All products are produced on a print-on-demand basis. Orders cannot be modified or canceled once production begins.
Production and shipping timelines may vary due to order volume, seasonal demand, or carrier conditions. Obscura is not responsible for delays caused by shipping carriers or events beyond reasonable control.
Risk of loss transfers to the merchant once an order is handed over to the shipping carrier.
Obscura is not responsible for disputes between merchants and their end customers. Merchants are solely responsible for customer service, returns, refunds, and compliance with consumer protection laws.
Fees and Payments
The Obscura app is currently provided without subscription fees.
When end customers place orders through your store, they pay you directly via Shopify Checkout. Merchants are responsible for paying Obscura for product manufacturing and shipping costs. Payments are processed securely by credit card through a third-party payment processor.
If subscription fees or additional charges are introduced in the future, such fees will be processed exclusively through the Shopify Billing API. Merchants will be notified in advance before any new fees are applied.
Intellectual Property
Merchants retain ownership of all designs and content submitted to the Service.
By using Obscura, you grant a limited, non-exclusive license to use submitted content solely for the purpose of producing and fulfilling orders.
Obscura retains all rights to its software, platform, trademarks, and service-related content. No rights are granted except as expressly stated in these Terms.
Merchants are solely responsible for ensuring their content does not infringe intellectual property or other third-party rights.
Prohibited Use
You agree not to use the Service for unlawful purposes, including submitting infringing, offensive, or misleading content, or attempting to interfere with the operation or security of the Service.
Obscura reserves the right to suspend or terminate access if these Terms are violated or if continued use presents legal or operational risk.
Data and Privacy
Obscura collects and processes merchant data in accordance with its Privacy Policy.
For end customers purchasing through your store, you act as the data controller for any personal data collected through your sales channel. You are responsible for ensuring compliance with applicable data protection and privacy laws.
Termination
You may stop using the Service at any time by uninstalling the App.
Obscura may suspend or terminate access to the Service at its reasonable discretion if these Terms are violated or if continued use poses legal or operational risk.
Provisions that by their nature should survive termination, including intellectual property, payment obligations, limitations of liability, and governing law, shall survive.
Limitation of Liability
To the maximum extent permitted by law, Obscura shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill.
Obscura’s total liability arising from or related to the Service shall not exceed the total amount paid by the merchant to Obscura in the 30 days preceding the claim.
Changes to These Terms
Obscura may update these Terms from time to time. Changes take effect upon posting. Continued use of the Service constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed under the laws of the State of California, USA. Any disputes shall be resolved exclusively in the courts located in that jurisdiction.
